Terms & Conditions

Oji Bali Holiday is a family-owned tour operator that focuses on creating memorable and unique experiences around Southeast Asia and in select cities in the United States. Oji Bali Holiday offers a variety of tours and services (“Products”) made available by the Oji Bali Holiday team and its partners and related applications via its website located at www.Oji Bali Holiday.com (collectively, “Website”). The terms “we”, “us”, “our”, and “Oji Bali Holiday” refers to Oji Bali Holiday Group, or Oji Bali Holiday, LLC, a Wyoming Limited Liability Company and/or our affiliates, parent company, and subsidiaries. The term “you” or “traveler” refers to the traveler booking with us and all members of their group.

Contract. We draw your attention to the Terms and Conditions of travel below, these Terms and Conditions including all brochures, documents, correspondence and the terms and conditions of our Suppliers form the basis of the contract with you. Before making a booking with us you must ensure that you have read and understood these Terms and Conditions (raising any questions you may have with us). Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your booking you are accepting all of the Terms and Conditions laid out below and acknowledging that you have read the Terms of this contract and agree with them.

If you are making a booking as a group, the leader of the group is responsible for sharing these Terms and Conditions with all members of the group and is financially responsible for the booking. We will not be liable for a group leader’s failure to share these Terms with all travelers in their group.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these Terms and Conditions on their behalf, and (c) the information supplied by you, or members of your group is true and correct.

Changes to these Terms and Conditions. We may change or otherwise modify the Agreement in the future, and you understand and agree that your continued access or use of this Website after such change signifies your acceptance of the updated or modified Agreement. We will note the date that revisions were last made to the Agreement at the top of this page, and any revisions will take effect upon posting. We will notify our members of material changes to these terms and conditions by either sending a notice to the email address provided to us at registration or by placing a notice on our Website. Be sure to return to this page periodically to review the most current version of the Agreement.

Violations by You. You agree that any violation of any such Terms and Conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel related product or service.

COVID 19 Release of Liability. By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, which cannot be controlled or eliminated by Oji Bali Holiday.

You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or canceled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine if you test positive at any point on a tour. Some locations may require you to have a vaccination. You are responsible for understanding these requirements and must not rely on Oji Bali Holiday to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID 19, Oji Bali Holiday has strongly encouraged the purchase of travel protection coverage including “cancel for any reason” coverage if and when available, and that should you fail to purchase travel protection coverage, Oji Bali Holiday shall not be liable to any losses howsoever arising. Oji Bali Holiday shall not be liable for any COVID losses not covered by your selected travel protection coverage.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Oji Bali Holiday LLC, its members, officers, agents, and/or employees, Suppliers, and other tour members (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

Products, Services, and Booking Reservations. When you are ready to start your next travel adventure with us simply search for the tour you are looking to experience, read through the description detail in full, input your information into the participant information box, and select “Add to Cart.” Should you have any questions about a tour, please be sure to contact us via WhatsApp as listed on our website or call us at 617.229.7271 prior to booking any tour. Once you’ve selected the tour or tours you’d like to book, check-out by accessing your cart, and confirm your payment details. Payment is due in full at the time of booking. Failure to make a payment may result in the cancellation of your participation on the tour. Upon completion of your booking, you’ll receive an email confirmation via the email you provided to us when booking. By booking a tour with us, you acknowledge that you accept the practices described in this Agreement. Any false or fraudulent reservation is prohibited, and any user who attempts such a reservation may have his or her Oji Bali Holiday account terminated.

Our bookings do not include airfare. You must not make any air reservation until you receive confirmation of your booking. Your contract for airfare is with the air carrier and subject to its terms. We shall not be liable for any change fees or cancellation fees or other additional costs/s you incur with the air carrier.

Oji Bali Holiday Member-Only Deals. Oji Bali Holiday offers discounts and time-limited promotions, known as “Member Only Deals”, to registered Oji Bali Holiday users. You must have a Oji Bali Holiday account in order to browse or book a Member Only Deal. Member Only Deals are confirmed instantly upon booking and all sales are final. If you cancel or amend a Member Only Deal, you will be charged a 100% cancellation fee.

Credit Card Bookings. When you book a reservation for a service or product through the Website, Oji Bali Holiday collects your payment information and processes your payment as described below under “Payment Processing”. Oji Bali Holiday accepts the following credit cards: Mastercard, Visa, American Express, Discover. There is no charge or service fee for processing credit or debit card payments on the website. Full payment by credit or debit card is required to make a reservation. Payment will be listed as Oji Bali Holiday on the credit or debit card statement. You further agree that under this agreement, the payment processing services for services purchased on this website are provided by Stripe, PayPal, Google Pay or by Oji Bali Holiday, LLC, depending on the type of payment method used for the purchase of services.

The value of the transaction may be subject to taxes, duties, foreign transaction, currency exchange or other fees. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on Oji Bali Holiday.com and Oji Bali Holiday-affiliated websites, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees. Please note for bookings made in Brazil, the tax IOF (Tax Upon Financial Operations, 6.38%) is not included in the final booking value and will be charged to the credit or debit card used to make the purchase.

You agree and acknowledge that by entering your credit card information your card will be charged in full for any and all tours in your “cart” on the Website, and as such agree not to make any improper chargebacks.

In certain cases, you have the ability to dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Oji Bali Holiday retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:

Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.

Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.

Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.

Chargebacks resulting from force majeure or other circumstances that are beyond the control of Oji Bali Holiday or the Supplier.

Chargebacks resulting because you do not agree with the cancellation policy.

Currency Converter. If a currency converter is provided on the Website and applications, currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Currency quotes may not be updated on a daily basis. The information supplied by this application is believed to be accurate, but Oji Bali Holiday, and/or its affiliates do not warrant or guarantee such accuracy. When using this information for any financial purpose, we advise you to consult a qualified professional to verify the accuracy of the currency rates. We do not authorize the use of this information for any purpose other than your personal use and you are expressly prohibited from the resale, redistribution, and use of this information for commercial purposes.

Modifications & Amendments. All requests for modifications and amendments to your booking must be directed to the Oji Bali Holiday Customer Care Team who will process the request. See the section “Payment & Cancellations” below for additional information with respect to canceling a booking.

Oji Bali Holiday does not charge a fee to amend or change the dates of an existing booking if the request is received by our Customer Care team more than two (2) days ahead of your confirmed travel date.

All other date-change requests and amendments are subject to availability by our team and/or service providers; Oji Bali Holiday cannot guarantee the success of any date-change request.

If you request a date change within two (2) days or less of your confirmed travel date, Oji Bali Holiday will attempt to honor your request; however, changes made two days or less from your original travel date may be subject to an additional fee. For multi-day and overnight tours, date changes made within seven (7) days of your confirmed travel date may also be subject to additional fees.

If you make a purchase using a Oji Bali Holiday promotion code, or if you accept a discount or special-offer price during the Oji Bali Holiday checkout process, you may invalidate your discount or special-offer price by making any changes or amendments to your itinerary once your purchase is complete. Oji Bali Holiday may decide, at its sole discretion, to honor your discount or special-offer pricing if you make a post-purchase change or amendment to your itinerary. However, Oji Bali Holiday reserves the right to invalidate your discount or special-offer pricing if you make any changes to your confirmed itinerary.

Occasionally our team and/or service providers make changes to tour dates, prices, inclusions, coverage, age requirements, and other Product features and/or requirements. As a result, Oji Bali Holiday reserves the right to cancel, change or substitute any service, tour, ticket or product that you have booked at this Website, at any time, for any reason. In such cases, if you are dissatisfied with the alternatives offered, you are entitled to a full refund of the original purchase price. Notwithstanding the above, when we are informed in advance by our service providers of a significant change to a booking and/or to a tour, product or event, we make every reasonable effort to notify the consumer, travel agent and/or distributor as appropriate, in order to amend or re-issue the booking where feasible. Participant is responsible for any additional costs for air tickets or other travel arrangements not made by us.

Pricing & Inclusions/Exclusions. Prices listed on the Website are per person, unless otherwise specified. Prices are based on the local tariff at the time of quoting, converted at the prevailing foreign-exchange rate as determined by Oji Bali Holiday. Price quotations are subject to change without notice, until a booking has been confirmed.

Transfers
Certain tours include transfers by car, van or bus. You must be on time for all transfers. There will be no refund for missed or unused transfers. For transfers where we pick you up to commence the tour, please be sure to provide us with the correct pick-up location and arrive there 15 minutes prior to the pickup time.

Meals
Meals and/or snacks are not included on all tours, please refer to the inclusions listed on your itinerary to confirm the included meals and snacks on your tour. Travelers with special diets should make such a request at the time of booking; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, Oji Bali Holiday and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise Suppliers of your request, but we cannot guarantee their availability.

Sightseeing/Activities
Sightseeing tours and activities are included as provided in the individual itineraries. These tours and activities are designed to accommodate individuals as well as groups. As a courtesy to others in the tour and/or activity, it is mandatory that you be on time for all scheduled experiences. Tours and activities will begin on time and failure to arrive will be considered a no-show for which no refunds will be available. It is essential that you keep in mind that tour and activity times are set to accommodate climate, crowd size and the best viewing options for our groups. At times, early morning departure times may help create a better experience. Therefore, late arrivals cannot be accommodated.

Changes to Itineraries
Oji Bali Holiday reserves the right to make changes to its published itineraries which we deem insignificant and are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services.

While no changes are anticipated, there may be occasions when certain alterations become necessary. These can be due to religious holidays, national celebrations, or unforeseen events including weather, tide schedules, governmental closures, acts of God, or any other reason. Oji Bali Holiday reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. Additionally, historic sites undergo renovations from time to time which can obscure viewing or otherwise change the nature of visiting these sites. No tours will be canceled due to renovations, although Oji Bali Holiday may choose to amend itineraries for such sites. These changes will not be considered a material change and will not be considered cause for cancellation by the guest.

If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement. In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.

Exclusions
Any items and matters not referred to in your itinerary are not included in the tour price. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax. Prices do not include tips/gratuities to tour directors, drivers or local guides; passport and visa fees; baggage and personal insurance; any items of a personal nature; taxes or duties; and any beverages or food not specifically listed under “Inclusions” on the product pages of the Website.

Cancellations. If you wish to cancel a reservation made via the Website, please refer to our standard cancellation policy below. When canceling a booking, you will be notified via email, telephone or by text message of the total refund amount you will receive, if any.

The standard cancellation policy for Oji Bali Holiday is:

a 100% refund (minus payment processing fees) for cancellations made at least 48 hours in advance of the start date of the experience.

Cancellations made within 48 hours of the start date of the experience will receive no refund.

No refunds are available once a tour or service has commenced, or in respect of any package, accommodation, meals or any other services utilized. Please note that there is no refund issued for bad weather once the tour has started. However, if the weather is so bad that the tour cannot commence then we will work to reschedule the tour for you.

Passports, Visas & Insurance. When you book international reservations using this Website, you are responsible for ensuring that you meet all foreign entry requirements and that your travel documents, including passports, inoculations, and visas, are in order.

For passport and visa requirements, please consult the relevant embassy or consulate for information. Because requirements may change at any time, be sure to check for up-to-date information before booking and departure. Oji Bali Holiday accepts no liability for travelers who are refused entry onto a flight or into any country because of the traveler’s failure to carry the travel documents required by any airline, authority, or country, including countries the traveler may just be passing through enroute to his or her destination.

As visa and health requirements are subject to change without notice, we recommend that you verify health and visa requirements with the appropriate consulate prior to departure. It is also your responsibility to consult your physician for current recommendations on inoculations before you travel internationally, and to ensure that you meet all health entry requirements and follow all medical guidance related to your trip.

We strongly recommend that you purchase a comprehensive travel insurance policy with “cancel for any reason” coverage prior to departure to protect your purchase. Such travel protection should include Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel Protection Plans included cancel for any reason coverage must be purchased in close conjunction with your travel purchase. If you cancel your trip or significantly alter travel dates, your travel insurance policy may reimburse the cost of cancellation fees and related expenses. Oji Bali Holiday is not qualified to answer technical questions about benefits, exclusions, and conditions of travel insurance plans. In addition, we cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have questions about your travel protection, call your insurer or insurance agent or broker and please review your travel insurance policy carefully for related terms and conditions.

Travel to certain destinations may involve greater risk than others. Oji Bali Holiday urges passengers to investigate and review travel prohibitions, warnings, announcements and advisories issued by the United States Government and destination country governments prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov and www.treas.gov/ofac. It is your responsibility to be aware of any and all requirements for admittance to a country or state, including COVID-19 requirements. Should you choose to travel to a country that has been issued a travel warning or advisory, Oji Bali Holiday will not be liable for damages or losses that result from travel to such destinations.

You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler/s to miss flight(s), and subsequent scheduled travel bookings and tours. Oji Bali Holiday bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

BY LISTING INFORMATION RELEVANT TO TRAVEL TO PARTICULAR INTERNATIONAL DESTINATIONS, Oji Bali Holiday DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK AND IS NOT LIABLE FOR DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.

Force Majeure. Oji Bali Holiday assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Oji Bali Holiday that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our Suppliers, we will refund these to you without any charge by Oji Bali Holiday.

Non-Responsibility. Oji Bali Holiday, and its employees, shareholders, agents, and representatives use third party Suppliers to arrange tours, transportation, sightseeing, and all other services related to this tour. Oji Bali Holiday is an independent contractor and is not an employee, agent, or representative of any of these Suppliers. Oji Bali Holiday does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, ATV, boat, white water rafts, hotel or restaurants, or any other entity that supplies services related to your tour. All Suppliers are independent contractors and are not agents or employees or representatives of Oji Bali Holiday. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither Oji Bali Holiday, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Oji Bali Holiday. Oji Bali Holiday assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; Oji Bali Holiday assumes no responsibility or liability for personal property; and Oji Bali Holiday shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. Oji Bali Holiday accepts no responsibility for lost or stolen items. Oji Bali Holiday reserves the right to refuse any traveler or potential traveler at its sole discretion.

Assumption of Risk/Waiver, Hold Harmless and Release of Liability. Traveler is aware that travel in certain areas as a traveler is undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Oji Bali Holiday and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Traveler understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness and death. Traveler hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release Oji Bali Holiday LLC and its owners, employees, agents, and assigns (collectively Oji Bali Holiday) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of Oji Bali Holiday and traveler hereby covenant not to sue Oji Bali Holiday for any such claims or join any lawsuit or action that is suing Oji Bali Holiday. This agreement also binds your heirs, legal representatives and assigns. The terms of this ASSUMPTION OF RISK/WAIVER, HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

Indemnification. Traveler agrees to and shall indemnify and hold harmless Oji Bali Holiday Group, Oji Bali Holiday, LLC and its owners, employees, agents, and assigns (collectively “Oji Bali Holiday”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by Oji Bali Holiday (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Agreement and (ii) any damage caused by traveler while participating in the trip.

Your Behavior. In the sole discretion of Oji Bali Holiday and our Suppliers, Oji Bali Holiday may require any traveler to leave the tour if it is reasonably believed that the traveler has engaged in, is engaged in, or is threatening to engage in, behavior that may adversely affect the safety, security, comfort, enjoyment, or well-being of other travelers or Oji Bali Holiday representatives and our Suppliers, including, but not limited to, behavior that is disruptive, verbally abusive, physically abusive, obnoxious, harassing, discriminatory, or obscene; or has failed or refused, or is failing or refusing, to follow Oji Bali Holiday rules and procedures. In the event a traveler is removed, such traveler may be left at any city or location without any liability to Oji Bali Holiday or its representatives or Suppliers. Oji Bali Holiday shall not be required to refund any portion of the price paid by any traveler who is removed under the terms of this paragraph, nor shall Oji Bali Holiday be responsible for expenses for lodging, medical care, meals, transportation, or any other expenses incurred by the traveler.

Pre-existing Medical Conditions/Persons with Disabilities. The nature of many of the destinations we travel to means that in some cases they may be unsuitable for those who use a wheelchair or have a lack of mobility. However, we will be delighted to discuss the feasibility of your participation in any of our trips.

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your tour, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. Oji Bali Holiday will communicate requests to Suppliers but cannot be responsible if ADA accommodations are not available. Any accommodation provided will be at the sole expense of the traveler requiring the accommodation. Please note that accommodations outside of the US may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.

Our Suppliers are, unfortunately, unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify Oji Bali Holiday at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance.

Photograph/video Likeness. Traveler hereby gives consent to Oji Bali Holiday to publish any photographs and/or videos of the trip or Traveler in printed or electronic media without obtaining further consent and without compensation. Each Traveler releases Oji Bali Holiday and its representatives from any liability in connection with any use of such photographs and/or video.

Jurisdiction and Governing Law. This Website is operated by a U.S. entity and this Agreement is governed by the laws of the State of Wyoming, USA. You hereby consent to the exclusive jurisdiction and venue of courts in the State of Wyoming, USA and stipulate to the fairness and convenience of proceedings in such courts for all disputes arising out of or relating to the use of this Website. You agree that all claims you may have against Oji Bali Holiday, LLC. arising from or relating to this Website must be heard and resolved in a court of competent subject matter jurisdiction located in the State of Wyoming. Use of this Website is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including, without limitation, this paragraph.

Class Action Waiver/Limitation of Damages & Notice of Claim. You agree that you will only bring claims against Oji Bali Holiday in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Oji Bali Holiday shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Oji Bali Holiday unless you have first provided a typewritten notice of claim to Oji Bali Holiday within 30 days after the trip or cancellation of the tour.

Entire Agreement & Severability. This agreement, including any other documents, including invoices, we provide you, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Oji Bali Holiday. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
